Fokus Turizm İnş. ve Dan. Tic. A.Ş. (the "Company" or "Cape Bodrum") places the highest priority on the privacy and security of the personal data of our guests and users visiting our website, www.capebodrum.com. This policy explains how we collect, use, store, and share your personal data in accordance with the Law on the Protection of Personal Data No. 6698 (“LPPD”) and relevant international legislation.

 

1. Data Controller and Representative

In accordance with the LPPD, Fokus Turizm İnş. ve Dan. Tic. A.Ş., in its capacity as data controller, may process, record, store, classify, and update your personal data within the scope of the purposes explained below, in accordance with the law and the principle of honesty, and may disclose and transfer it to third parties in cases permitted by the legislation and/or limited to the purpose for which they are processed.

 

2. Purpose of Processing

Your Personal Data Your personal data are processed in accordance with the fundamental principles set forth in the LPPD for the purposes of conducting our Company’s operational activities, business relations, and human resources processes; meeting the requests of relevant persons; providing products and services in the most appropriate manner; continuing marketing and technical processes; and ensuring the commercial security of the Company. They are stored securely in physical or electronic environments for the period appropriate for the purpose of processing. Fokus Turizm İnş. ve Dan. Tic. A.Ş. acts in compliance with all obligations set forth in the relevant legislation, particularly the LPPD.

 

3. Transfer of Your Personal Data

Your personal data processed within the scope of the explained purposes may be transferred to our business partners, shareholders, authorized public institutions and organizations, private individuals, firms from which support services are received to conduct our activities, and independent audit companies within the framework of legal obligations and limitations, in accordance with the fundamental principles set forth in the LPPD and within the conditions and purposes of processing personal data specified in Articles 8 and 9 of the LPPD.

 

4. Transfer of Data Abroad

Your personal data may be transferred by Fokus Turizm İnş. ve Dan. Tic. A.Ş. to persons and organizations resident in foreign countries declared by the Personal Data Protection Board (“Board”) to have adequate protection, either through "obtaining explicit consent" in light of the principles in Article 4/2 of the LPPD or without obtaining explicit consent in the presence of situations in Articles 5/2 and 6/3, and according to the rules in Article 9 of the Law.

 

5. Method and Legal Basis for Collecting Your Personal Data

Your personal data are collected through different channels and based on the legal reasons stated above to conduct our activities and to improve the services we offer. In this framework, your personal data may be processed and transferred through explicit consent or without explicit consent in the presence of situations in Articles 5/2 and 6/3 of the LPPD.

 

6. Your Rights as a Data Subject Under Article 11 of the LPPD

As a data subject, if you submit your requests regarding your rights to Cape Bodrum, Fokus Turizm İnş. ve Dan. Tic. A.Ş. will conclude the request within thirty days at the latest. Your rights under Article 11 are as follows:

 

  • Learning whether personal data is processed,

     

  • Requesting information if personal data has been processed,

     

  • Learning the purpose of processing and whether they are used appropriately,

     

  • Knowing the third parties to whom data is transferred domestically or abroad,

     

  • Requesting correction of incomplete or incorrectly processed data,

     

  • Requesting the deletion or destruction of personal data within the framework of the conditions in Article 7,

     

  • Objecting to results against you arising from analysis through automated systems,

     

  • Requesting compensation for damages in case of loss due to unlawful processing.

     

To exercise your rights, you can submit your request in Turkish and in writing, or via registered electronic mail (KEP) address, secure electronic signature, or the e-mail address registered in our system, in accordance with Article 13/1 of the LPPD.
